Terms of Service

Welcome to Eternal Nox ("Nox"), interactive role playing- and forum-based internet community website (http://www.eternalnox.com). These Terms of Use (Service/Agreement) apply to all users, members, customers and individuals who use and/or visit Nox (collectively and/or individually called "Members").

Members are advised and urged to thoroughly read and understand these Terms of Use before further browsing, using and/or registering for Nox. By browsing, using and/or registering to Nox the Member acknowledges that they have read, understood and agree to be bound by the following and any future rules (collectively known as the "Terms") or modifications to said terms written below. If you do not agree to be bound by the rules set on this page you are not to make use of Nox and/or any websites (individually or collectively known as "Pages") affiliated directly and/or indirectly with Nox.

Nox asks that Members never display or post personal information such as physical addresses, real names, telephone or cell phone numbers or any other such personally identifying information that might be used to find them in real life (off-line) on Nox.

Individual Rules for Forums, Features and Services. When using Nox Members will be subject to additional rules applying to certain areas of the website only. Such rules may often be found, but are not limited to, "Announcement" and/or "Sticky" threads, found in the top of each forum. Such individual rules are hereby incorporated into these Terms by reference.

Modification of Terms. At any time Nox reserves the right to add, edit and/or remove parts of these Terms. Such changes take effect instantly after they are applied. Members are asked to please check this page on a regular basis to make sure they remain up-to-date with the current rules. All modifications made to the Terms apply to all users at all times; continued use of Nox after such changes are made constitutes a binding agreement from all Members to abide by those changes.

Prohibited Conduct.
By using Nox you agree NOT to:
a) Harass, threaten, "stalk" or defraud other Members
b) Post, send or make hateful, racially or ethnically insulting, threatening, pornographic, embarrassing, libelous or otherwise inappropriate messages to other Members.
c) Make unsolicited offers, proposals, advertisements, chain letters, or send junk mail/messages to other Members
d) Impersonate another Member, or accessing another Member's account without permission
e) Fail to deliver any payment for a purchase made through Nox
f) Share passwords issued by Nox with another Member, or encourage and/or trick another Member to share their password
g) Misrepresent the source, identity or content of information transmitted through Nox, for example, falsely claiming ownership of any created work posted or displayed on Nox
h) Use Nox for any and all illegal activity or purpose
i) Interfere or circumvent any security-related features on Nox
j) Intentionally interfere with the operation of Nox or the enjoyment of any Member, or in any other way post inflammatory and/or insulting statements to provoke a reaction in other Members (also known as "Trolling")
k) URL-hack or otherwise attempt to locate or access unreleased areas of Eternal Nox. This can very well merit an instant ban of your account.
l) Post links to other sites for personal gain, such as Reference-Links to other web-communities or links to pages which tally how many people you have referred to that page.
m) Enforce "fake" rules (i.e., rules not found in the TOS or the individual forum rules) by telling other people not to do a specific thing and/or giving them the impression that they are breaking a rule when they in fact aren't. This will result in a warning for the enforcing user (the "Enforcee").

Account Termination and Banning The Administration of Eternal Nox reserves the right to restrict an individual's access to Eternal Nox at any time for any reason. Warnings may, on a case-by-case basis, be extended as a courtesy to the user, however, an account may be terminated without warning. Reasons or explanations for the banning of an account, be it permanent or temporary, may or may not be provided to the user.

Usernames Some usernames may be seen as improper or inappropriate, and can be designated as such by the Administration. Make sure that your username does not violate any rules found in this TOS. If a username is deemed inappropriate, the user in question will be given an opportunity to request a more suitable name, or it will be changed to something else at the discretion of the Admin.

Botting Using third-party programs or tools to optimize, extend, increase gain or otherwise abuse any systems on Nox ("botting") will result in an instant ban. Users who knowingly and willingly use ill-gained stars or items, such as from hacked accounts or through botting, will also be subject to investigation and, most likely, a ban themselves.

Ownership Nox owns and holds all rights to items and art found on the site, with the exception of user-submitted content found in the forums. Items and stars held within a User's account are considered "borrowed," and Users have no right to sell, trade or otherwise transfer ownership of these in exchange for real-world currency, in the form of money, credit, services, or obligations.

Trading or selling items that belong to Nox for similar virtual items from other web-communities ("Off-site Trading") is prohibited and will result in an instant ban of the accounts involved. Furthermore any other websites involved in such transactions shall be informed of such activity on their site.

Privacy Policy

PLEASE NOTE Eternal Nox is designed, in content and nature, for people above the age of 13. If you are below 13 years of age, please get your parents' or legal guardians' consent before signing up for this website. We also ask that parents have a talk with their children about using a internet community such as Eternal Nox. The creators and staff of Eternal Nox can in no way be held responsible for children below the age of 13 using the website without their parents' consent. If the staff at Eternal Nox discover a user under the age of 13 who is using the website without parental consent, the staff will take appropriate action to delete said account. If you as a parent discover that your child has been using the services at Eternal Nox without your consent, you may contact the administrators through the Contact Page (link here).

When registering for Eternal Nox ("Nox"), you will be asked to submit some basic information such as an E-mail address and a username and password. Please note that Nox will never sell or otherwise make publicly your e-mail address without your consent. As such, your e-mail address will never be sold to advertisement companies, nor any other company or individual. Your e-mail address is necessary to verify your account in our database, as well as to facilitate password recovery (see below).
Your username and password will be stored within our database, but will not be retrievable by our moderators, administrators nor any other individual. If you lose your password you are advised to use the Password Recovery function found when logging in. Again, please note that we cannot recover lost passwords upon request from you. Furthermore, all users of Nox are responsible for the security of their own passwords.

Any and all personal information not required to sign up for Nox are submitted at one's own risk, and Nox takes no resonsibility for misuse of said content by your or any other user of the Nox community. It is strongly advised that Members not post or otherwise display their full names, addresses, civil registration numbers, phone numbers, bank information or any other information that may be used to locate a member and/or to conduct illegal activity. As previously stated, all such content is submitted at one's own risk, and Nox cannot be held responsible for any misuse of it.

Nox allows certain third-party websites and companies to put advertisements on the website. Such websites may use certain technologies to record Member activity around the advertisements, and may record information such as IP addresses. Members are advised to read the privacy policies of these companies to make sure you agree with the terms under which they run.

Changes to the Privacy Policy may be made at any time by the administrators of Nox. We will aim to keep the policy as it is. All changes made to the Privacy Policy will be effective 30 (thirty)days after they have been made. Notice of changes to the Privacy Policy may not always be announced; it is advised that all Members check this page frequently to ensure they are up-to-date with the policy. Dates of past changes or updates are recorded below, along with the dates when these changes becoming effective.
